1. What OnYourRoute Is (and Isn't)

OnYourRoute is an online marketplace that connects senders (people who need something delivered) with drivers (people already making a trip who have extra space in their vehicle).

OnYourRoute is a marketplace, not a delivery company. We do not employ drivers, own vehicles, or perform deliveries. We provide the platform that helps two parties find each other and coordinate a delivery.

When you use OnYourRoute — whether as a driver or a sender — you are agreeing to these Terms of Service ("Terms"). These Terms form a binding agreement between you and OnYourRoute ("we," "us," or "the platform"). By creating an account or using the platform, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, do not use the platform.


2. Who Can Use the Platform

To use OnYourRoute, you must:

By posting a route as a driver, you confirm that you meet all of these requirements. OnYourRoute does not verify licences or insurance — that responsibility is yours. If you misrepresent your eligibility, you are solely liable for any consequences.


3. Driver Terms

You are an independent user, not an employee

Drivers using OnYourRoute are independent individuals. You are not an employee, contractor, agent, or representative of OnYourRoute. Nothing in these Terms creates an employment relationship, agency, partnership, or joint venture between you and OnYourRoute.

You control how, when, and whether you accept deliveries. OnYourRoute does not direct your work, set your schedule, or supervise your trips. You decide everything about how you operate.

Your vehicle costs are your responsibility

As an independent user, you are solely responsible for all costs associated with operating your vehicle, including:

OnYourRoute does not reimburse fuel costs or any other vehicle operating expenses, separately or in addition to your payout. The 60% payout you receive from each completed delivery is your total compensation. No additional reimbursement is provided.

Your payout

For every completed delivery transaction, drivers receive 60% of the delivery fee paid by the sender. The remaining 40% is the OnYourRoute platform fee. Payouts are processed through the platform's payment system.

Tips

Senders may optionally leave a tip. 100% of any tip goes directly to the driver. OnYourRoute does not take a cut of tips.

Your obligations as a driver

Taxes

You are responsible for reporting and paying any applicable income tax, HST/GST, or other taxes on amounts you earn through the platform. OnYourRoute does not withhold taxes on your behalf.


4. Sender Terms

Pack it right

You are responsible for properly packaging your items before handing them to a driver. Items must be:

No illegal or dangerous items

You may not use OnYourRoute to ship contraband, controlled substances, firearms, hazardous materials, perishables, live animals, or anything else that is illegal to transport under Canadian or Ontario law. If you do, you are solely liable for any legal consequences, and your listing will be removed.

5. Payments and Fees

How payments work

All payments are processed through OnYourRoute's built-in payment system. Senders pay the delivery fee when confirming a booking. Drivers receive their payout after successful delivery confirmation.

Platform fee

OnYourRoute charges a 40% platform fee on every completed delivery transaction. This fee covers the cost of operating the platform, including matching, payment processing, and customer support.

Driver payout

Drivers receive 60% of the delivery fee. This is the total amount payable — no additional gas reimbursement or expense top-up is included.

Tips

Tips are entirely optional. If a sender chooses to add a tip, 100% of that tip goes to the driver. The platform fee does not apply to tips.

Pricing

Delivery prices are calculated based on distance between towns. The price shown to the sender at the time of booking is the final price, unless the delivery is modified by mutual agreement before pickup.

Taxes

Prices displayed may or may not include applicable taxes. You are responsible for understanding and meeting your own tax obligations based on your use of the platform.


6. Cancellations and Refunds

Cancellation by the driver

If a driver cancels after a booking is confirmed, the sender receives a full refund. Drivers who repeatedly cancel confirmed bookings may be removed from the platform.

If something goes wrong during delivery

If a delivery is not completed due to circumstances outside both parties' control (e.g., vehicle breakdown, road closure), OnYourRoute may offer a partial or full refund at its sole discretion on a case-by-case basis. Contact us at the address in Section 13.

Disputes between drivers and senders

OnYourRoute is not a party to delivery agreements between drivers and senders. We may, at our discretion, attempt to mediate disputes, but we are not obligated to do so and our decisions are not legally binding.


7. Prohibited Items and Uses

The following are strictly prohibited on OnYourRoute:

Violations may result in immediate removal from the platform and, where appropriate, reporting to law enforcement.


8. Limitation of Liability

We are a marketplace, not a carrier

OnYourRoute is a technology platform that facilitates connections between independent users. We are not a licensed carrier, courier, freight broker, or logistics company.

OnYourRoute is not liable for any loss, damage, theft, delay, or non-delivery of items transported through the platform. All delivery arrangements are between drivers and senders directly.

No warranty

The platform is provided "as is" and "as available." We make no warranties — express or implied — regarding the reliability, accuracy, or fitness of the platform for any particular purpose. We do not guarantee that deliveries will be completed, that drivers will show up, or that items will arrive undamaged.

Cap on liability

To the maximum extent permitted by applicable law, OnYourRoute's total liability to you for any claim arising out of or related to your use of the platform shall not exceed the lesser of:

No consequential damages

In no event will OnYourRoute be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, loss of data, or loss of business, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those cases, our liability is limited to the fullest extent permitted by law.


9. Indemnification

You agree to defend, indemnify, and hold harmless OnYourRoute and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

10. Dispute Resolution

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Jurisdiction

Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

Informal resolution first

Before initiating any formal legal action, you agree to contact OnYourRoute in good faith and attempt to resolve the dispute informally. Most issues can be resolved quickly through a simple conversation. Reach us at the contact information in Section 13.

Time limit on claims

Any claim you have against OnYourRoute must be brought within one (1) year of the date the claim arose. Claims brought after that period are permanently barred.


11. Privacy

When you post a listing on OnYourRoute, some of your information — including your name and general trip details — is visible to other users on the board. When two parties choose to connect, contact information (email, phone) is shared between them to coordinate the delivery.

We collect only the information necessary to operate the platform. We do not sell your personal information to third parties.

By using OnYourRoute, you consent to this use of your information as described here and in any separate Privacy Policy we publish.


12. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. If the changes are significant, we'll make reasonable efforts to notify active users.

Continuing to use the platform after updated Terms are posted means you accept the new Terms. If you don't agree with the changes, stop using the platform.

Termination

Either party may end this relationship at any time. You can stop using the platform whenever you like. We can remove any listing or user from the platform at any time, for any reason, including violations of these Terms or conduct that harms the community.
